End User License Agreement for [hearDELIGHT App]
Effective Date: September 9, 2025
Thank you for choosing the [hearDELIGHT App] (the "App"). This App is designed as an auditory assistance tool for seniors experiencing mild to moderate hearing difficulties, as well as for factory workers exposed to high levels of noise. This End User License Agreement ("Agreement") is a legal contract between you (an individual or a single entity) and [hearDL LLC] ("we", "us", or "our") regarding your use of the App.
1. Acknowledgment and Acceptance of Agreement
By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree, do not download, install, or use the App.
2. License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal and non-commercial purposes on a compatible smartphone device you own or control.
3. Not a Medical Device
The App is intended solely as an auditory assistance tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a licensed healthcare provider with any medical concerns.
4. Restrictions
You may not:
Rent, lease, lend, sell, redistribute, or sublicense the App.
Copy, reverse-engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works based on the App or any portion thereof.
5. User Data Privacy
To safeguard user privacy, we do not collect user data, such as audiograms, advanced setting, or custom keywords. The user data is exclusively stored on your device.
6. Termination
This license is effective until terminated by you or us. Your rights under this Agreement will terminate automatically and without notice if you fail to comply with any term or condition.
7. Disclaimer of Warranty
The App is provided "as is" and without warranties of any kind, either express or implied.
8. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any personal injury or incidental, special, indirect, or consequential damages arising from or related to your use of the App.
9. Free and Premium Versions
The App includes both free and premium versions:
The free version is available at no cost.
The premium version offers enhanced features and is available through either a one-time payment or a recurring subscription.
10. Subscription
The premium version of the App may be billed on a subscription basis, with recurring charges applied weekly, monthly, or yearly, depending on your selected plan. Subscriptions will automatically renew at the end of each billing cycle unless canceled by either you or us before the renewal date. You may manage or cancel your subscription at any time through your Google account settings on your device.
11. One-Time Payment
Alternatively, the premium version of the App may be purchased via a one-time payment. In this case, access to premium features is granted for a fixed duration. After the fixed period expires, access will automatically end without renewal.
12. Free Trial
We may, at our sole discretion, offer a free trial of the premium version for first-time subscribers.
A valid payment method must be provided to initiate the trial. No charges will apply until the trial ends. If not canceled before the trial period ends, the applicable fee for your selected payment type will be automatically charged.
We reserve the right to modify or terminate the Free Trial offer at any time without prior notice.
13. Subscription Fee Changes
We may modify subscription fees at our discretion. Any fee changes will take effect at the end of your current billing period. You will receive reasonable advance notice, and continued use of the App after changes take effect constitutes agreement to the new fees.
14. Refunds
All payments are non-refundable. However, we may consider refund requests related to subscriptions on a case-by-case basis and issue refunds at our sole discretion.
15. Changes to This Agreement
We reserve the right to revise or replace this Agreement at any time. Continued use of the App after changes are made constitutes your acceptance of the revised Agreement.
